Beyond DOMA and Prop 8

Principal Cases
  1. Hollingsworth v. Perry, 133 S. Ct. 2652 (2013) (concluding that proponents of Proposition 8 lack Article III standing to appeal decision of U.S. district court invalidating Prop 8 and enjoining its enforcement).

  2. United States v. Windsor, 133 S. Ct. 2675 (2013) (Section 3 of the Defense of Marriage Act violates the "liberty of the person protected by the Fifth Amendment of the Constitution" because "no legitimate purpose overcomes the purpose and effect to disparage and to injure those whom the State, by its marriage laws, sought to protect in personhood and dignity.")
